Summary of Changes from 2008 Draft

Changes were made to the 2008 revised draft to create the proposed passenger vessel accessibility guidelines.  Although advisory notes and advisory figures are included in the internet version of the proposed guidelines, this advisory material does not appear in the proposed guidelines that appeared in the Federal Register and when finalized will also not appear in 36 CFR 1196.  Therefore, the following list of changes compares the text of the 2008 draft to the text of the proposed guidelines that appeared in the Federal Register.  Changes in advisory notes (and references to figures) are not included below.  Changes in text include:

  • Various Sections — Moving and modifying the accessible means of escape requirements, now only in V207.  Also, replacing the term “area of temporary refuge” with “protected waiting area”.
  • V104.1.2 — Modifying how slopes are measured.
  • V105.2 — Adding the reference to the 2010 version of NFPA 72 for US flag vessels.  See questions in preamble regarding visible alarms in foreign flag vessels.
  • V106.5 — Modifying the definitions for administrative authority, assembly area, ferry, play component, and deleting definitions for area of refuge, area of evacuation assistance, evacuation station, ITC, occupant load, and SOLAS.
  • V201.1 — Moving the exception regarding furniture to V203.9.
  • V202.4 — Removing the alteration to primary function area provision (and related references in V202.2, V202.3 Exception 1, and V232.1 Exception 2, and old V202.5 and V413.2 Exception 2).
  • V202.5 — Deleting the section and moving “Alterations to Qualified Historic Passenger Vessels” provision to V202.4.
  • V203.8 — Changing the reference to raised “boxing and wrestling rings” from “sporting platforms”.
  • V203.9 — Clarifying that non-fixed furniture is not subject to guidelines.
  • V204.1 — Adding sentence referencing USCG regulations regarding certain stairways and stair towers.
  • V206.2.1 — Renumbering the nine existing vertical access exceptions, and adding a new exception (#4).
  • V206.2.1 — Modifying exception 5 to apply to all high speed vessels (not just ferries) and that do not transport overnight passengers.
  • V206.6 — Clarifying that the tonnage measurement applies to gross tonnage.
  • V206.7 — Reordering the subsections.
  • V206.7.3 — Removing the reference to V222 (Transportation Seating Areas).
  • V207 — Rewriting the entire section on accessible means of escape.
  • V208 — Modifying to include Department of Justice in establishing scoping requirements for accessible passenger boarding system addressed in V402.2, in addition to the Department of Transportation.
  • V209 — Removing the stairway scoping (except pool stairs addressed in V1005.6.1).
  • V213.2 Exception 3 to 5 — Replacing the phrase “no more than” with “at least”.
  • V213.2 Exception 5 — Modifying to apply to all high speed vessels (not just ferries) and that do not transport overnight passengers.
  • V215.1 — Modifying the section to apply general emergency alarm requirements to public areas only (V224.4 and V806.3 apply the requirements to guest rooms with communication features), adding a second exception addressing certain spaces.
  • V216.4.2 — Removing the section which addressed required signage for areas of temporary refuge.
  • V216.4.3 — Deleting the section and moving contents to V216.4.2 and adding an exception for directional signage pertaining to the accessible means of escape.
  • V219.2.2 — Adding a requirement to provide assistive listening systems in all public areas with audio amplifications systems (e.g., having a ship’s public address system) used to communicate emergency information to passengers, except for passenger vessels with muster stations.
  • V219.3 — Simplifying exception 2 to allow the number of receivers to be determined by the maximum number of passengers a vessel is permitted to carry.
  • V224.2 — Adding an exception which caps the number of guest rooms required to be equipped with mobility features at five percent maximum (rounded up).
  • V225.3 — Clarifying the provision addressing self-service shelves to not apply to food service lines (addressed in V227.4).
  • V226.1 — Modifying to apply where tables and counters are provided, but not in assembly areas and transportation seating areas.  Those areas are addressed in V221 and V222 which reference V802.1.6.
  • V227.3 — Modifying the section to apply to each space having service counters, and adding an exception for smaller vessels.
  • V229 — Moving the guest room window scoping requirement to V806.2.8, and adding the dressing, fitting, and locker room scoping from old V238.
  • V234.2 — Clarifying that the pool lift requirement applies to each swimming pool provided (unless an exception applies).
  • V238 — Deleting the section and moving its contents (dressing, fitting, and locker room scoping) to V229.
  • V305.7.1 — Moving the exception for clear width of platform lifts to V409.2.
  • V305.7.2 — Moving the exception for clear width of boarding lifts to V411.7.
  • V309.4 — Moving the exception for door hardware to V404.2.7.
  • V402 — Modifying the section by adding the accessible passenger boarding system components (moved from old V412), and removing the accessible means of escape components (see “various sections” above).  The section already had the components for onboard accessible routes (V402.1).
  • V403.5.2.2 — Modifying the L shaped space for 90 degree turns by reducing its size.
  • V403.6 — Removing the guardrail exception.
  • V404.1 — Modifying the exception to include not requiring maneuvering clearance beyond the latch side of employee operated doors (from old V404.2.4 Exception 5)
  • V404.2.2 — Adding an exception to address employee operated doorways at entry and departure points, and evacuation points.
  • V404.2.3 — Adding exception 3 which allows the administrative authority to determine door width.
  • V404.2.4 — Moving exception 3 concerning single ramp access to V404.2.5.2.1.2 Exception and Exception 5 regarding employee operated doors to V404.1 Exception.
  • V404.2.4.4 — Moving intent of Exception 1 and 2 to V404.2.5.2.1 and V404.2.5.2.2.
  • V404.2.5 — Modifying the entire section regarding doors with coamings.
  • V404.2.7 — Adding exception for door hardware (from old V309.4 Exception)
  • V404.2.9 — Modifying the section to allow fire doors and watertight doors to have a minimum door opening force allowed by the administrative authority.
  • V405.2 — Moving intent of door coaming ramp exception to V404.2.5.2.1.1 and ramp exception for manually powered boarding lifts to V411.8. 
  • V405.7 — Moving ramp landing exception for doors with coamings to V404.2.5.2.
  • V405.7.3 — Moving ramp landing exception for boarding lifts to V411.8.
  • V407.4.9 — Modifying to require emergency visual communication in elevator cars, where emergency two-way communications are provided.
  • V407.4.10 — Deleting the section and the handrail provision.
  • V408.4.8 — Deleting the section and the handrail provision.
  • V409.2 — Modifying to include size (from old V409.3), and adding exception for the clear width of inclined platform lifts (from old V305.7.1).
  • V409.7 — Deleting the section and the handrail provision.
  • V410 — Removing provisions related to accessible means of escape (see new V207) and adding gangway provisions (from old V413).  Changes in the gangway technical provisions include clarifying V410.4 Exception 2 and modifying V410.7 Exception 1 to allow transition plates to comply with V403 or V405.
  • V411 — Removing areas of temporary refuge (now called protected waiting areas) provisions (see new Advisory V207.1), and adding manually powered boarding lift provisions (from old V414).  Changes in boarding lift provisions include adding clear width exception (from old V305.7.2) in V414.7, and adding ramp slope exception (from V405.2) and modified landing exception (from old V405.7.3) in V414.8
  • V412 — Deleting the section and moving the accessible passenger boarding system components to V404.2.2.
  • V413 — Deleting the section and moving gangway provisions to V410.
  • V414 — Deleting the section and moving boarding lift provisions to V411.
  • V502 — Modifying stair section to only address pool stairs subject to V1005.6.1.
  • V503 — Modifying handrail stair references in addressing pool stairs.
  • V608.2.4 — Modifying the rinsing shower space requirements.
  • V608.3.2 — Modifying to not require grab bar opposite the seat of the roll-in showers, but if provided, it must comply, and removing the exception and advisory note.
  • V608.3.4 — Deleting the section and rinsing shower grab bar requirements.
  • V702 — Removing “reserve” label and adding technical requirements for visible notification devices (which references section 18.5 of NFPA 72 - 2010) for public areas of US flag passenger vessels (see V806.3.3 for guest rooms). 
  • V802.1 — Adding an exception concerning wheelchair spaces in smaller ferries with only one transportation seating area that has less than 100 square feet.
  • V806.2.7 — Modifying the exception to only exempt maneuvering clearance requirements on one side of connector doors, not hardware, etc.
  • V806.2.8 — Adding section addressing windows (from old V229).
  • V806.3 — Modifying the section to now require communication guest rooms of US flag passenger vessels to have visible notification appliances for the general emergency alarm and smoke detector alarm that comply with section 18.5 of NFPA 72 — 2010.
  • V1104 — Deleting the section and reference to tender boarding systems.
