Background on the Public Rights-of-Way Rulemaking

The Board issued proposed guidelines on accessible public rights-of-way for public comment in July 2011.  This proposal includes revisions that were made in response to public comments received on earlier drafts of the rule the Board released in 2002 and 2005. 

The guidelines are based on recommendations from an advisory committee formed by the Board.  The Public Rights-of-Way Access Advisory Committee was composed of 33 members representing disability organizations, public works departments, transportation and traffic engineering groups, design professionals and civil engineers, government agencies, and standards-setting bodies. The committee issued its report, "Building a True Community," in January 2001.

Timeline:

  • December 21, 1992 - Board proposes guidelines for state and local government facilities that includes a section on public rights-of-way
  • June 20, 1994 - An interim final rule for state and local government facilities is published
  • January 13, 1998 - Final rule for state and local government facilities published; based on comments to the interim final rule, the Board reserves requirements for public rights-of-way
  • October 20, 1999 - Board organizes the Public Rights-of-Way Access Advisory Committee
  • January 10, 2001 - The Public Rights-of-Way Access Advisory Committee submits its report to the Board
  • June 17, 2002 - Board releases draft guidelines based on the Committee's report and makes them available for public comment
  • October 28, 2002 - Deadline for comments on the draft guidelines
  • November 23, 2005 - Board releases copy of revised draft guidelines for purposes of gathering information for a cost analysis
  • July 26, 2011 - Board publishes proposed guidelines for public comment
  • February 2, 2012 - Deadline for public comments
