Detention and Correctional Facilities Overview

In spite of state challenges to coverage of detention and correctional facilities, the Supreme Court has held that title II of the ADA applies to such institutions. Access must be provided for detainees with disabilities as well as staff, program providers, and visitors. While these types of facilities must follow basic requirements for access in ADAAG Sections 1-10, they also have unique characteristics that require specific provisions. These characteristics include:

  • More stringent security considerations
  • Specific communications requirements
  • Long-term living facilities

Section 12 provides scoping and technical specifications for access to detention and correctional facilities, and includes advisory information on their application in the Appendix.
